State Contract and Payment Actions in November

In November, the Office of the State Comptroller approved 1,384 contracts for state agencies and public authorities valued at $25.5 billion and approved more than 12.3 million payments worth more than $11.7 billion. The office rejected 91 contracts and related transactions valued at $610 million and nearly 5,200 payments valued at nearly $39.7 million, primarily for mistakes, insufficient support for charges, and improper payments. The Governor’s Executive Order 202 suspended the Office of the State Comptroller’s review and approval of contracts related to the COVID-19 crisis through Jan. 1, 2021. At the administration's request, OSC has been expediting payments for purchases. These are reported in Open Book.

Major Contracts Approved

Department of Environmental Conservation

  • $2 million with Continental Construction LLC to construct a new multi-use building and rehabilitate the pavilion at Camp Colby in Franklin County.
  • $1.2 million to Essex County for shuttle bus services for hikers.

Department of Financial Services

  • $18.8 million with 99 Washington LLC & One Commerce Plaza to lease office space in Albany County.

Office of General Services

  • $2.4 million with RJ Green Construction Corp. to replace roofs and repair windows at New York State Psychiatric Institute in New York County.
  • $1.5 million with Stilsing Electric Inc. to provide emergency power at Sheridan Avenue steam plant in Albany County.

Department of Health

  • $24.3 billion for Medicaid managed care plans including $16.1 billion with United Healthcare of New York Inc., $6.4 billion with Health Insurance Plan of Greater New York, and $1.8 billion with YourCare Health Plan Inc.
  • $5.8 million to North Shore University Hospital for HIV/AIDS regional prevention and support services.

Office of Parks, Recreation & Historic Preservation

  • $2.9 million with LDC Construction Co. Inc. for Buckhorn Island shoreline and Green Island habitat enhancement at Buckhorn Island State Park in Erie County.
  • $1.5 million with Architectural Resources PC for design services in Allegany, Genesee and Niagara counties.

City University of New York

  • $28.5 million with Collins Building Service Inc. for building maintenance and janitorial services at The Graduate Center.

State University of New York Construction Fund

  • $3.5 million with AOW Associates Inc. for lecture center renovations at University at Albany.

State University of New York

  • $8.5 million with Sterling Glass of New York Inc. for replacement and repair of glass windows, doors, and screens at Stony Brook University.
  • $5.9 million with University Surgical Associates LLP for on-call trauma and general surgery services at Upstate Medical University.

Department of Transportation

  • $11.3 million with Vector Construction Corp. for bridge deck replacements on Route 635 over I-690 in Onondaga County.
  • $5.8 million with Coastal Contracting Corp to clean, repair, or replace drainage structures at various locations in Nassau and Suffolk counties.
  • $4.6 million with TRC Engineers Inc. for construction management and quality assurance services for John F. Kennedy International Airport access improvements.
  • $3.6 million with Cold Spring Construction Co. for rehabilitation of Route 31 bridge over Erie Canal in Monroe County.
  • $3.1 million with Dolomite Products Company Inc. for mill and inlay, drainage, and ADA compliance work in Onondaga County.
  • $2.6 million with Bette & Cring LLC for bridge replacement on Route 2 in Rensselaer County.
  • $2.3 million with Union Concrete and Construction Corp. for bridge replacement on Ridge Road in Orleans County.

Major Payments Approved

Tax Refunds and Credits

  • $547.4 million for 83,360 personal income tax refunds.
  • $145.4 million for 13,601 corporate and other refunds.
  • $112.5 million for 89,552 property tax credits.

Department of Civil Service

  • $264.4 million to CVS Caremark to provide pharmacy benefit services for the Empire, Excelsior and Student Employee Health plans.
  • $26 million to Beacon Health Options Inc. for benefit services for the Empire Plan Mental Health & Substance Abuse Program.

State Education Department

  • $2.4 billion in general aid payments to 426 school districts.

Empire State Development Corporation

  • $2 million to CenterState Corporation for the Economic Opportunity business competition under the Growing ENtrepreneurs & Innovators in UpState New York (GENIUS NY) program.
  • $1.8 million to the Village of Fredonia for planning, design and construction costs to create a vibrant, walkable downtown and increase amenities for residents and visitors.
  • $1.5 million to 43North LLC for working capital and equity investment awards for the startup business plan competition in Buffalo.
  • $1 million to the Community Foundation of Buffalo to assist families at an increased risk of losing their homes due to the high cost of maintenance and energy.

Gaming Commission

  • $7.7 million for tribal-state compact payments to Cayuga, Chenango, Cortland, Herkimer, Lewis, Oneida, Onondaga, Oswego and Otsego counties.

Office of General Services

  • $11.7 million for hourly-based IT services, including $2.3 million to PSI International Inc., $1.6 million to Knowledge Builders Inc., $1.4 million to MVP Consulting Plus Inc. and $6.5 million to 28 other vendors.

Department of Health

  • $57.5 million for purchases to support the COVID-19 pandemic response.
  • $19.7 million to Maximus, Inc. for assistance with the Health Benefit Exchange, including insurance enrollment and call center operations.

Division of Homeland Security and Emergency Services

  • $15.8 million for purchases to support the COVID-19 pandemic response.

Office of Information Technology Services

  • $12.9 million for purchases to support the COVID-19 pandemic response.

Department of Labor

  • $3.1 billion for payments under the Unemployment Insurance, Pandemic Unemployment Assistance, Federal Pandemic Unemployment Compensation and Lost Wages Assistance programs.

Division of Military and Navy Affairs

  • $1.2 million for purchases to support the COVID-19 pandemic response.

State University of New York

  • $10.3 million for purchases to support the COVID-19 pandemic response.

Department of Transportation

  • $2.4 million to Granite Construction Northeast Inc. for replacement of the Kosciuszko Bridge in Kings County.

Payment Rejections and Other Cost Recoveries

The office rejected nearly 5,200 payments valued at nearly $39.7 million, including tax refunds and credits valued at almost $4.9 million. The Comptroller’s auditors also recovered more than $278,000 from vendors owing debts to the state, and held payments of nearly $585,000 pending resolution of disputes between subcontractors and prime contractors.

Cumulatively through November for calendar year 2020, the Comptroller’s office has approved 13,640 contracts valued at $219.1 billion and has approved more than 169.4 million payments worth nearly $194.6 billion, including nearly 149.7 million unemployment insurance payments valued at more than $56.8 billion. The office has rejected 1,185 contracts and related transactions valued at over $7 billion and more than 127,800 payments valued at more than $413.6 million primarily for mistakes, insufficient support for charges, and improper payments.
