State Contract and Payment Actions in March

In March, the Office of the State Comptroller approved 2,095 contracts for state agencies and public authorities valued at $52.1 billion and approved more than 3.6 million payments worth more than $33.1 billion. The office rejected 241 contracts and related transactions valued at $1.7 billion and more than 6,800 payments valued at nearly $25.3 million, primarily for mistakes, insufficient support for charges, and improper payments. Major Contracts Approved

Department of Civil Service

  • $385.2 million with Anthem Healthchoice Assurance Inc. to provide administrative services for the New York State Dental Plan.

Department of Environmental Conservation

  • $12.8 million with U.S. Department of Geological Survey for several groundwater related projects.
  • $1.8 million with Benchemark Printing Inc. for printing of the Conservationist and Conservationist for Kids magazines.

Office of General Services – Design & Construction

  • $8.1 million with ABCD Construction Corp. for exterior improvements at the Manhattan Psychiatric Center in New York County.
  • $4.5 million with Structural Preservation Systems LLC to provide concrete repairs at the Empire State Plaza in Albany County.
  • $2.1 million with Daniel J. Lynch Inc. to renovate the Unadilla and East Worcester rest areas in Otsego and Delaware Counties.
  • $1.3 million with Edger Enterprises of Elmira Inc. to re-pave parking lots and connecting roadways at the Horseheads State Armory in Chemung County.
  • $1.3 million with Digesare Mechanical Inc. to mitigate water infiltration and repair building 22 at the Mohawk Correctional Facility in Oneida County.

Department of Health

  • $3.9 million with Moderna US Inc. for pediatric COVID-19 vaccines.
  • $2.1 million with Kivvit LLC for marketing and communication services.

Department of Motor Vehicles

  • $277.6 million with Fast Enterprises LLC for a Driver and Registration System. 
  • $1 million with opAD Media Solutions LLC for media buy services. 

Office of Parks, Recreation and Historic Preservation

  • $5 million with Hudson Meridian Construction Group LLC for construction management services related to park development at the Sojourner Truth State Park in Ulster County.
  • $4.3 million with Fidelis Contracting Inc. for renovation of the Administration Building at the Belmont Lake State Park in Suffolk County.
  • $3.5 million with Whitney East Inc. for entrance road improvements at the Stony Brook State Park in Steuben County.
  • $3.3 million with A-1 Land Care Inc. for site improvements at the Joseph Davis State Park in Niagara County.
  • $1.2 million with M.A. Schafer Construction Inc. for construction of a warming hut at the John Boyd Thatcher State Park in Albany County.

State University Construction Fund

  • $11.9 million with Mengler Mechanical Inc. for HVAC rehabilitation in the Visual Arts Building at SUNY Purchase in Westchester County.
  • $3.7 million with Buffalo Construction Consultants Inc. for construction management services related to a new lecture hall project at Binghamton University in Broome County.
  • $1.6 million with J&K Plumbing and Heating Inc. to upgrade the building management systems at SUNY Delhi in Delaware County.

Department of Transportation

  • $21.8 million with Cobleskill Stone Products Inc. for pavement and bridge rehabilitation on Interstate 88 in Otsego County. 
  • $12.7 million with Elderlee Inc. for guide rail replacements in Rockland County.   
  • $11.4 million with Argenio Brothers Inc. for intersection improvements on Route 376 in Dutchess County. 
  • $6.8 million with Bette & Cring LLC for bridge deck replacements on Interstate 90 in Albany and Rensselaer Counties. 
  • $4 million with Eberl Iron Works Inc. for breakaway sign support systems.

Major Payments Approved

Tax Refunds and Credits

  • $2.5 billion for 1,915,641 personal income tax refunds.
  • $138.3 million for 13,560 corporate and other tax refunds.
  • $4.3 million for 4,729 property tax credits.

Department of Civil Service

  • $380.7 million to CaremarkPCS Health LLC to provide pharmacy benefit services for the Empire, Excelsior, and Student Employee Health plans.
  • $34 million to Carelon Behavioral Health for the administration of the Empire Plan’s mental health and substance use disorder program.

State Education Department

  • $7.9 billion in general aid to 636 school districts. 
  • $1.9 billion in excess cost aid to 668 school districts for school-aged special education students.

Empire State Development Corporation

  • $17 million to the Research Foundation for the State University of New York for construction, renovation, equipment and operational costs for the Federally Designated Institute’s Testing, Assembly and Packaging facility in Rochester.
  • $1.4 million to Edison Welding Institute Inc. for working capital for the Buffalo Manufacturing Works’ “Shift 2.0” program to assist small and medium-sized manufacturing companies in Western New York.

Office of General Services

  • $21.1 million for hourly-based IT services, including $5.2 million to Knowledge Builders Inc., $2.4 million to Panha Solutions Inc., $1.7 million to Greycell Labs Inc., $1.5 million to Computer Technology Services Inc., $1.1 million to MVP Consulting Plus Inc., $1.1 million to Software People Inc., and $8.1 million to 23 other vendors.

Department of Health

  • $28.8 million to Maximus Inc. for assistance with the Health Benefit Exchange, including insurance enrollment and call center operations.
  • $27.4 million to Maximus US Services Inc. for enrollment broker services for the Office of Health Insurance Programs.
  • $4 million to Currier McCabe & Associates Inc. for the development, implementation, and operation of the Medicaid data warehouse and the Office of Health Insurance Programs Data Mart.
  • $2.5 million to One Brooklyn Health System Inc. for the Health Care Facility Transformation Program in Kings County. 

Department of Labor

  • $269.1 million for payments under the Unemployment Insurance, Pandemic Unemployment Assistance, and Federal Pandemic Unemployment Compensation programs.

Office of Temporary and Disability Assistance

  • $18.6 million for the Emergency Rental Assistance Program.
  • $2.6 million for the Landlord Rental Assistance Program.

Department of Transportation

  • $7 million to El Sol Contracting/ES II Enterprises JV for bridge repairs and painting on the Gowanus Viaduct Expressway in Kings County.
  • $2.6 million to Albany County Airport Authority for the terminal expansion project at Albany International Airport.

Other Payment Rejections and Other Cost Recoveries

DiNapoli’s office rejected tax refunds and credits valued at more than $18.5 million. Auditors also recovered nearly $184,000 from vendors owing debts to the state and held more than $324,000 in payments pending resolution of disputes between subcontractors and prime contractors. 

Cumulatively through March for calendar year 2024, DiNapoli’s office approved 5,121 contracts valued at $60.6 billion and approved nearly 8.9 million payments worth more than $59.5 billion. The office rejected 582 contracts and related transactions valued at $9.3 billion and nearly 13,900 payments valued at more than $66.7 million primarily due to errors, improprieties or lack of documentation.
