Purpose
To inform the agency of new Additional Pay earning codes and to provide instructions to pay the out-of-title work.
Affected Employees
Troopers in Bargaining Unit 07 and Commissioned/Non-Commissioned Officers in Bargaining Unit 17
Background
Pursuant to the Memorandum of Agreement, dated May 5, 2005, between the State of New York and the Police Benevolent Association, members working in an out-of-title capacity are entitled to compensation at the rate of the higher grade.
Effective Date(s)
On and after April 3, 2008
Contract Provisions and Eligibility Criteria
In the event of an existing vacancy, a Field Commander may designate a member to serve in an “Acting” capacity. This member is entitled to receive the difference in pay between the “Acting” rank and that of their current rank from the first day of the “Acting” assignment.
The assignment must be for fifteen (15) or more working days in order to be eligible to receive the out-of-title compensation.
This payment is pensionable and included in the calculation of Overtime.
OSC Actions
OSC has created two (2) new Additional Pay earnings codes to be used to pay the out-of-title compensation to eligible employees:
- GRV (State Police Grievance) must be used to report the out-of-title worked
- AGR (Adj St Police Grievance) must be used to report mid-pay period adjustments to the out- of-title worked
Agency Actions
Beginning February 12, 2009, the agency must use the following procedure when reporting the out-of-title payments on the Additional Pay page:
Earnings Code: | GRV |
Effective Date: | 4/3/08 or the date employee becomes eligible for the payment |
End Date: | The date the out-of-title work ceases or 6 pay periods from the effective date, whichever comes first |
Additional Earnings: | The annual difference between the employee’s current salary and “acting’ salary |
Earnings Code: | AGR |
Effective Date: | The mid-pay period date the employee becomes eligible for the payment |
End Date: | N/A |
Earnings: | The difference in the biweekly amount paid by the system and the over or underpayment for that partial pay period |
Goal Amount: | Same as Earnings amount |
For payments prior to 4/3/08, the agency must use the following procedure when reporting the out-of-title payments on the Time Entry page:
Earnings Begin Date: | Date employee becomes eligible for the payment prior to 4/3/08 |
Earnings End Date: | The date the out-of-title work ceases or 4/2/08, whichever comes last |
Earn Code: | ADJ |
Amount: | Applicable amount |
The agency must enter the following information on the General Comments page in the same pay period in which the out-of-title payment is submitted:
- Employee’s current title and salary
- “Acting” title and salary
- Calculation of the difference in salaries
- Calculation of the amount to be paid
- Number of pay periods to be paid
- End date of the payment, if known
