Background
Chapter 567 of the Laws of 2010 created the Special Commission on Judicial Compensation to examine, evaluate and make recommendations with respect to adequate levels of compensation and non-salary benefits for Judges and Justices of the state paid courts of the Unified Court System. The Commission has recommended that all NYS Judges receive phased-in salary increases over the next three fiscal years beginning April 1, 2012. This recommendation will become law unless modified or abrogated by statute prior to April 1, 2012.
Effective Date
The salary increase will be effective March 29, 2012 and will be paid in checks dated April 11, 2012
Eligibility Criteria
Judges and Justices of the UCS in Bargaining Unit 86 whose Pay Basis Code is LEG with an Employee Status of Active (A) or Leave with Pay (P) on or after 3/29/2012 are eligible for this salary increase.
OSC Actions
OSC will process the April 2012 salary increase for Judges and Justices who meet the eligibility criteria as follows:
- If the Employee Status equals Active (A) or Leave with Pay (P) on 3/29/2012, OSC will insert a row in the Job Data record using the Action/Reason code of PAY/SAC (Pay Rate Change/Mass Salary Increase) with an Effective Date of 3/29/2012.
- If the employee does not meet the eligibility criteria on 3/29/2012 but becomes eligible after 3/29/2012, OSC will inset a row in the Job Data record using the Action/Reason code of PAY/CSL (Pay Rate Change/Correct Salary) and an Effective Date equal to the date of the Hire, Rehire, Position Change, Transfer or Return from Leave action.
- If the employee has subsequent rows in an eligible position, OSC will insert a row in the Job Data record using the Action/Reason code of PAY/CSL (Pay Rate Change/Correct Salary).
The compensation rate on each inserted row will be updated as follows:

Control-D Report Available After Processing
Control-D Report NHRP704 (Mass Salary Payment Report) will be available after processing of the automatic salary increase. This report identifies all Judges and Justices who received the salary increase and identifies the salaries that were automatically increased. Other fields on the report include EmplID, Employee Record Number, Employee Name, Grade, Bargaining Unit, Pay Basis Code, Part-time Percentage, Action Reason and Increment Code.
