Holiday pay is additional compensation for time worked by an employee during their regularly scheduled 7.5 or 8 hour shift on a date observed as a holiday by the State. To be eligible for such compensation, an employee must be subject to the Civil Service Attendance Rules* and entitled to time off with pay on such a day unless the employee has filed a Holiday Waiver electing to receive accruals instead of compensation.
*Seasonal Hourly employees may be eligible for Holiday Pay although they are not subject to Civil Service Attendance Rules. Refer to the current appropriate contract for more information. (Contracts)
Employees designated as Management/Confidential in a position allocated to Grade 23 or above, or in an unallocated position where the salary equates to Grade 23 or above, are ineligible for holiday pay.
Holiday compensation, except as noted below, is calculated at the rate of 1/10 of the normal biweekly gross salary, including any additional salary factors (pre-shift briefing pay is excluded). Holiday pay for less than a full day is prorated.
Employees in positions in the Administrative, Operational or Institutional Services, Division of Military and Naval Affairs (except Firefighters) Units, Professional, Scientific & Technical Services unit or designated MC (below Grade 623 or with a salary equated below Grade 623) are eligible to receive additional compensation for time worked on Thanksgiving or Christmas Day will receive payment calculated at time and a half or 15% (.15) of their biweekly gross salary.
An employee whose pass day is other than the holiday, and who normally works on the day on which such holiday falls, as part of his or her work week, would be entitled to holiday pay for such service, but would not receive overtime compensation for that day. When an employee works on a holiday which is also his or her pass day, the employee is entitled to receive holiday compensation for time worked during regularly scheduled hours and overtime compensation for hours worked in excess of 40 hours within the week. Generally, no employee may receive both holiday pay and a day off in lieu of holiday pay. There is an exception for Memorial Day and Veterans’ Day if the employee is a veteran.
NOTE: Employees in the Administrative, Operational or Institutional Services Units, Division of Military and Naval Affairs Unit or Management/Confidential (below grade 623) who are called into work on a holiday will receive compensation for at least 1/2 day of salary at straight time (or 1/2 day of compensatory time off). For employees in the Administrative, Operational, Institutional Services or Division of Military and Naval Affairs Units who are called into work on Thanksgiving or Christmas, such additional compensation is calculated at the time and a half rate as explained above. If the employee works more than 1/2 day, he or she would then receive holiday pay for the actual number of hours worked.
