Standby on-call is additional compensation authorized by the Director of the Budget for employees eligible to accrue overtime credits who are required to be available for immediate recall, and who must be prepared to return to duty within a limited period of time. Such additional compensation is paid upon the approval of the Director of the Budget. The compensation is due for each shift that an employee is scheduled to remain, and actually remains available, for recall and is computed on the basis of the work-day rate including any additional salary factors. In order for employees to be paid Standby, the employee must be on a roster approved by DOB.

The current negotiated rate for employees who occupy positions in the CSEA (Administrative, Operational, Institutional, DMNA units) and PEF (Professional, Scientific and Technical Services unit) is 25% of the daily rate of pay plus any miscellaneous payments as applicable. This is reported as 1 shift of 8 hours. The negotiated rate for standby on-call is a set rate and employees are entitled to receive that amount even if they are required to remain available for less than an eight-hour period. The negotiated benefit does not provide for the payment to be prorated when an employee is placed on standby on-call for less than an eight-hour period. Therefore, if an employee is scheduled to be on standby for 4 hours, they receive 1 shift or if they are scheduled for a 10 hour shift, the employee is entitled to two (2) full shifts or two units.

For employees in Council 82 and PBANYS (APSU Agency Police Services Unit) the standby rate is 20% of the daily rate including any additional factors. This is reported to PayServ as 1 unit or shift for each 8 hour shift or part thereof. Employees in these units are only paid for the part of the unit they are assigned to be on Standby. If the employee is assigned to be on Standby for 4 hours, they would receive one half (1/2) of a unit or shift.

For employees in the SUNY UUP (University United Professional Services Units), effect July 1, 2019, the rate is $6.00 per hour, except in NYC and on Long Island where it is $8.00. There is an extensive list of eligible titles in the UUP contract. This is reported on the Time Entry page as the number of units representing the number of hours or part thereof on standby. They can be submitted for as long as the employee is on standby on-call.
Such payment is not part of the employee's basic salary and does not affect other provisions of the law concerning determination.
Where an employee receives to standby on-call pay during a payroll period when any overtime is worked, the amount of total standby pay due for that period must be factored into the overtime calculation for all overtime worked, not just that associated with the standby.
Standby/On-call and Recall to Work
An employee who occupies a position in the CSEA or PEF units is eligible to receive standby pay for each 8-hour shift on standby in addition to any overtime or recall pay he or she may be entitled to upon being recalled to work.
An employee who occupies a designated position in the UUP Unit for which standby on-call is authorized is not entitled to such additional on-call compensation in the event he or she is actually recalled to work.
Standby Calculation
Standby on-call pay for CSEA, PEF, MC, Council 82, and PBANYS is calculated as follows:

Determine the employee's total annual salary including any additional derived biweekly payments earned including but not limited to location, geographic, inconvenience.

Determine the daily rate by multiplying the annual (plus any differentials) by the applicable biweekly factor (.038356 or .038251) and dividing by 10 and then multiplying by 25% or 20% as needed.

Multiply this daily standby rate by the number of shifts (reported as 1 = 8 hours) actually required to be on standby to determine the amount of payment.
- The maximum number of units (shifts) that can be earned per day is 3.

The maximum number of shifts in a pay period is 32;
- 14 days per biweekly x 3 shift per day = max shifts 42 shifts per biweekly minus 10 shifts worked = 32 max shifts per pay period that can be on Standby/On-call.

Under special conditions an employee may be assigned to Standby while charging accruals, therefore exceeding the 32 unit shift calculations. Comments should be included in these transactions.
