Per the Memorandum of Understanding between the State and various Unions, employees who are called to active duty in support of the War on Terror who have exhausted their paid military leave provided by Section 242 of Military Law are eligible to receive the difference in pay if the employee’s military biweekly earnings are less than their State biweekly earnings.
The agency must place the employee on Military Leave in PAYSERV using the appropriate Reason code:
- LOA/MLS (Military Stipend) pertains to Military Orders related to Homeland Security, Operation Enduring Freedom etc.)
- LOA/MLL (Military Leave) pertains to Military Orders not related to the War on Terror.
- LOA/MTS (Military Training Stipend) Pertains to Training Leave at reduced pay not related to the War on Terror
The agency is responsible for providing OSC with copies of the employees Military Orders and Leave and Earnings Statements (LES)
(If an employee is going out again under the same orders that have been amended, a new LES is not required.)
OSC will review the Military Orders and Leave and Earning Statements and will determine if the employee is due a stipend.
Calculation:
Normal State Salary (Comprised of employee’s base pay plus any Location and Geographic Pay)
Minus
Military Salary (Comprised of the employees Basic Pay, Basic Housing and Subsistence Allowance)
Military Stipend (The difference between the employee’s Normal State bi-weekly salary and their Military bi-weekly Salary)
If OSC decides the employee is due a stipend, OSC will change the employee’s Pay Basis Code to BIW on Position Data and insert a PAY/MLS row on the employee’s Job Data record with the stipend amount.
OSC will also enter any necessary Time Entry Transactions.

Return to Payroll
When an employee is due to return to the payroll from a Paid Military Stipend leave, the agency must send OSC an Update Position form so that OSC can change the employee’s Pay Basis Code back to ANN.
The agency must then enter a Rein Leave row on the employee's Job Data record.
